Privacy Notice for Job Applicants

Material Automation (Thailand) Co., Ltd. (“MAT”) is committed to protecting the rights relating to your personal data (the “Personal Data”) in accordance with the Personal Data Protection Act B.E. 2562 (2019), including any other applicable laws and/or regulations relating to or issued in connection with such Act. Accordingly, MAT has prepared this Privacy Notice to inform you, as the data subject, of the purposes and details of the collection, use, disclosure, and/or destruction of the Personal Data that you disclose to MAT, as well as your rights under the applicable laws relating to Personal Data.

1. Purposes of Personal Data Processing and Legal Basis

Your Personal Data will be collected, used, and/or disclosed only to the extent necessary for the purposes of your recruitment or employment process under this Privacy Notice, based on the applicable legal bases for carrying out the following principal purposes:

1.1 Contractual Necessity or to process your request/application before entering into a contract (Contractual Basis): The processing of your Personal Data, as specified in Clauses 3.1-3.8, is necessary for the purposes of employment, recruitment, personnel selection, and consideration for employment in various positions with MAT, including the consideration of your application or the taking of steps at your request prior to MAT entering into an employment contract with you.

1.2 Legitimate Interest Basis: The processing of your Personal Data is necessary to take steps for the legitimate interests of MAT or other juristic persons, provided that such processing does not exceed the scope of your reasonable expectations, such as risk management, monitoring, audit, investigate, internal organizational management, crime prevention, as well as the security of systems and networks, such as image processing from CCTV systems.

1.3 Consent Basis: The processing of your Personal Data for specific purposes as specified in Clause 3.9 is carried out in accordance with your consent, or a third party’s consent that you have provided to MAT, and only in cases where it is necessary to process such Personal Data.

2. Sources from Which MAT Collects Your Personal Data

MAT collects various types of your Personal Data and obtains such Personal Data from multiple sources, as specified below:

2.1 Personal Data that MAT receives or has access to from sources other than you directly, such as recruitment websites on which you have disclosed your Personal Data, recruitment agencies to which you have provided your Personal Data, or referrals made by MAT’s current employees.

2.2 Personal Data that MAT receives directly from you, including data collected through job application forms, telephone interviews, online interviews conducted via applications or platforms, in-person interviews, or through various communication channels, such as the head office or branch offices, email, social media, and postal mail.

2.3 Personal Data that MAT receives from other sources as informed by you, including your former employers, referees, and/or agencies required to conduct background checks necessary for employment, such as the National Credit Bureau, hospitals where you undergo health check-ups, and the Criminal Records Division or other background check service providers.


3. Types of Personal Data Collected, Used, or Disclosed

3.1 Personal information: photographs, first name, last name, nickname, gender, age, date of birth, nationality, marital status, ID card number, signature, CCTV footage, information contained in documents issued by government authorities, and/or additional information in the case of foreign nationals, such as passport number, immigration records, documents required for the application for and renewal of work permits, and Tax ID number.

3.2 Contact information: address, telephone number, email address, and LINE ID.

3.3 Family member information: first name, last name, relationship, occupation, company’s name, and personal telephone number.

3.4 Referee information: first name, last name, relationship, position, company’s name and address, company’s telephone number, and personal telephone number.

3.5 Emergency contact information: first name, last name, relationship, and personal telephone number. In the event that you provide MAT with Personal Data of third parties pursuant to Clauses 3.3-3.5, whether such Personal Data relates to family members, referees, former employers, or emergency contacts, you are required to inform such data subjects of this Privacy Notice of MAT and the details regarding the collection, use, and/or disclosure of their Personal Data prior to or at the time you disclose such Personal Data to MAT. You must also obtain consent from such third parties (where required) or rely on other applicable legal bases for providing their Personal Data to MAT. MAT shall deem that you have the lawful authority and have complied with the applicable legal requirements for the disclosure of such third parties’ Personal Data. You hereby represent and warrant that the disclosure of such Personal Data has been duly acknowledged and consented to by the data subjects in accordance with applicable laws, in order to ensure that MAT is able to lawfully collect, use, and/or disclose the Personal Data of such third parties.

3.6 Educational information: educational background, academic qualifications, academic transcripts, proof of graduation, certificates of professional qualification, professional licenses, certificates of completion for training courses that you wish MAT to consider for employment purposes, language proficiency, and/or typing skills.

3.7 Employment information: position, work experience, length of service, resume/CV, job descriptions, reasons for leaving previous company, as well as salary information, wages, other compensation, salary adjustments, annual bonuses, employee benefits, and other benefits previously received.

3.8 Other information: any other Personal Data obtained by MAT during the job interview process within the scope of the purposes for employment consideration, including opinions, hobbies, written test results, audio recordings, photographs, video recordings, and any other information deemed to be Personal Data under applicable laws.

3.9 Sensitive Personal Data: religion, race, health information, criminal records, disability, and biometric data. MAT will not collect, use, and/or disclose such Sensitive Personal Data without your explicit consent, unless otherwise required or permitted by applicable laws.

In this regard, you have the right to refuse to disclose your Sensitive Personal Data without any adverse effect on the consideration of your employment. However, in the event that MAT is required to use Sensitive Personal Data for employment consideration and you do not give your consent to MAT, MAT reserves the right to decline to proceed with any other related actions.

4. Disclosure of Personal Data
MAT may disclose your Personal Data to third parties, including referees, former employers, educational institutions, hospitals, and background check agencies, subject to the scope of the purposes specified in Clause 1, to verify the information that you have provided to MAT.

5. Send or Transfer of Personal Data to Other Countries
If necessary, MAT may disclose, send, or transfer your Personal Data to the third parties, its parent company or affiliated companies located overseas, including Japan, as well as to third parties, cloud service providers, or server providers located abroad under contractual arrangements with MAT. Such countries may or may not have personal data protection standards equivalent to those of Thailand. In this regard, MAT will implement appropriate measures and safeguards to ensure that the disclosure, sending, or transfer of your Personal Data is carried out securely and that the data recipients maintain adequate and appropriate data protection standards, or that other exceptions permitted by applicable laws apply. MAT will require your consent where required by law in the event of cross-border transfers of Personal Data.

6. Security Measures for Personal Data
MAT will keep your Personal Data confidential in order to prevent unauthorized or unlawful access, collection, use, disclosure, or breaches of Personal Data by unauthorized or unrelated persons. In this regard, MAT will implement appropriate and sufficient IT security measures in accordance with the requirements prescribed by applicable laws.

7. Retention Period of Personal Data
MAT will retain your Personal Data for as long as necessary for the purposes of employment consideration and any actions taken prior to entering into an employment contract with you under this Privacy Notice. In the event that you are not selected for employment, MAT will destroy your Personal Data within one (1) year. In this regard, MAT will take appropriate steps to delete or destroy your Personal Data, or to anonymize such Personal Data so that it can no longer be used to identify you, once such Personal Data is no longer necessary for the aforementioned purposes.

8. Your Rights Regarding Personal Data
You have the rights as a data subject under the applicable laws. MAT shall comply with and act upon your rights in accordance with the law and MAT’s regulations upon receipt of your request. Your rights are as follows:

8.1 Right of Access and to obtain a copy of Personal Data: You have the right to request access to and obtain a copy of your Personal Data that MAT is collecting, using, and/or disclosing in relation to you. For your own privacy and security, MAT requires you to verify your identity before providing you with the requested Personal Data.

8.2 Right to Rectification of Personal Data: You have the right to request that MAT correct your Personal Data that is inaccurate, incomplete, misleading, or not up to date, which MAT has collected, used, disclosed, and/or transferred (whether domestically or internationally), so that such Personal Data is accurate and complete.

8.3 Right to Data Portability: You have the right to receive your Personal Data that MAT holds in a structured, commonly used, and machine-readable format, and to have such Personal Data transmitted or transferred automatically. MAT shall transmit or transfer such Personal Data directly to another data controller, or provide such Personal Data directly to you, where: (1) such Personal Data that you have provided to MAT; and (2) MAT is processing such Personal Data based on your consent or for the performance of a contract entered into between MAT and you.

8.4 Right to Object: You have the right to object at any time to the collection, use, and/or disclosure of your Personal Data, such as for direct marketing purposes, where such processing is carried out on the basis of the legitimate interests of MAT, any individual, or any other juristic person within the scope of your reasonable expectations, or for the performance of a task carried out in the public interest. In the event that you raise an objection, MAT may continue to collect, use, and/or disclose your Personal Data only where MAT can demonstrate compelling legitimate grounds that override your rights, or where such processing is necessary for the establishment, compliance with, exercise, or defense of legal claims, as the case may be.

8.5 Right to Restriction of Personal Data Processing: You have the right to request that MAT restrict the processing of your Personal Data while MAT is verifying your request to object to or to rectify your Personal Data. In addition, where MAT is no longer required to retain your Personal Data and is required to erase or destroy such Personal Data in accordance with applicable laws, you may request MAT to restrict the use of such Personal Data instead.

8.6 Right to Withdraw Consent: You have the right to withdraw your consent previously given to MAT for the collection, use, and/or disclosure of your Personal Data at any time.

8.7 Right to Erasure or Destruction of Personal Data: You have the right to request that MAT erase or destroy your Personal Data, or anonymize such Personal Data so that it can no longer be used to identify you, which MAT has collected, used, disclosed, and/or transferred (whether domestically or internationally). However, MAT is not obligated to do so where MAT is required to retain such Personal Data for compliance with legal obligations, or for the establishment, exercise, or defense of legal claims.

8.8 Right to File a Complaint: You have the right to file a complaint with the Personal Data Protection Committee (PDPC) if you believe that the collection, use, disclosure of your Personal Data, or the refusal to comply with your request in relation to Personal Data, constitutes a violation of or non-compliance with the applicable laws.

The exercise of the rights above may be restricted under applicable laws. MAT may be required to refuse or may be unable to comply with your request where MAT is required to retain such Personal Data in order to comply with legal obligations, for the establishment, exercise, or defense of legal claims, to comply with applicable laws or court orders, for the performance of tasks carried out in the public interest, or where your request may infringe upon the rights or freedoms of other persons. In the event that MAT refuses your request, MAT will inform you of the reasons for such refusal. Whether MAT complies with or refuses your request, MAT will respond within thirty (30) days from the date MAT has received all relevant documents in accordance with MAT’s procedures and has completed the verification of your identity. You may exercise your rights through the contact channels specified in Clause 9.

9.2 If you wish to exercise any of your rights as set forth in this Privacy Notice, please download the Data Subject Request Form from www.mat.co.th and submit the completed form together with the required identification documents through the contact channels specified in Clause 9.1.
