Job Applicants Privacy Policy

Material Automation (Thailand) Co., Ltd. (hereinafter referred to as the “Company”, “We”), We are committed to the importance of protecting the rights of your personal data (the “Personal Data”). Under the Personal Data Protection Act B.E. 2562 ( 2019), including laws and/or regulations relating to or within such Acts. Therefore, this Privacy Policy has been created. To inform you of the details of the collection. Collection, use, disclosure and/or destruction of information you disclose to the Company;

1. Purposes for processing Personal Data and Legal Basis

Any Personal Data collected, used, disclosed, specified in this document, is necessary to apply for the job process, by the following legal basis and purposes:

1.1 It is necessary to execute upon request (contract base) for the processing types of Personal Data, as specified in 3.1-3.7, for the recruitment in determining employment in various positions of the Company, including considering employment with you,before the Company agrees to enter into an employment contract with you.

1.2 It is necessary to take steps for the legitimate interests of the Company or other juristic persons that are not beyond your reasonable expectations. Such as, for the purpose of security in processing CCTV, etc.

1.3 Obtaining the explicit consent for the specific purposes to process your Personal Data, as specified in 3.9, in accordance with your consent, or third party’s consent given to the Company by you., in case that it is necessary to process such Personal Data only.

2. The source which the Company collects your Personal Data

The Company collects various types of your Personal Data and sources from a various sources as specified as follows:

2.1 Information obtained by the Company from the job website, which you published your Personal Data on the Job Agency website, and/or disclosed to current employees of the Company.

2.2 Information received directly from you through job applications, telephone interviews, and online interviews through the Company’s programs.

2.3 Information that the Company received from other sources, which you have provided that source to the Company, such as former employer, referral person, and/or agency that requires to verify the background on the aspects necessary for employment (National Credit Information Company, the hospital where you undergo health check-ups, and personal information check centers), etc.


3. Types of Personal Data collected, used or disclosed

3.1 Personal information: photo, first name, last name, nickname, gender, age, date of birth, nationality, marital status, ID number/passport number, CCTV.

3.2 Contact information: address, phone number, email address

3.3 Family information: first name, last name, relationship, occupation, company name

3.4 Referrer information: first name, last name, relationship, position, company name and address, company phone number, and personal phone number

3.5 Emergency contact information, name, last name, relationship, and personal phone number
However, you assure that the disclosure of Personal Data in clause 3.3-3.5 is acknowledged by the data subject and obtain the legally consents to disclosure to the Company.

3.6 Education information: education details, transcripts to proof of graduation, and/or certificate of qualification, or certificate of passing the training course, that you wish the Company used for hiring considerations, language proficiency, typing skill.

3.7 Work information: position, resume, job description, reasons for quitting the company, including salary information and benefits that were received.

3.8 Other information obtained by the Company during a job interview within the scope of its objectives for employment considerations.

3.9 Sensitive Personal Data: religion, ethnicity health information, criminal record, which the Company will not collect, use and/or disclose this information without your consent, except as permitted by law.

In this regard, you have the right to refuse to disclose your sensitive Personal Data without influencing your employment considerations. However, in the event that the Company requires sensitive Personal Data to be considered and you do not give consent to the Company, the Company has the right to refuse any other related actions.

4. Disclosure of Personal Data
The Company may disclose your Personal Data to third parties within the scope of the objectives of Article 1, such as the former employer, educational institution, hospital, a background check agency to verify your information provided to the Company by you.

5. Sending or transferring Personal Data abroad
The Company may disclose or transfer your Personal Data to the third parties, Parent Company, Affiliates/subsidiaries of overseas companies, or servers located abroad that may or may not have the same level of data protection standards as Thailand. The Company will take steps and measures to ensure the safe transfer of your Personal Data and that the receiver has appropriate data protection standards, or other exceptions as permitted by law. The Company will ask for your consent if the law requires consent in the event of an international data transfer.

6. Security measures for Personal Data
The Company will keep your Personal Data in confidential and does not allow unrelated persons access to your Personal Data by providing the appropriate security measures.

7. Retention to collect Personal Data
The Company will retain the Personal Data of employees as long as necessary for the purposes of considering employment and taking actions taken before the employment contract with you. However, if you are not be employed, the Company will destroy your Personal Data within one (1) year.

8. Rights regarding your Personal Data
You have the right as the data subject under the law, and the Company shall comply with your rights in accordance with the laws and regulations of the Company upon receipt of your request, your rights are as follows:

8.1 Right to data Access: You have the right to access your Personal Data that is under MAT’s responsibility as well as request a copy of such data for you. In the case of you did not provide such data to MAT directly, you also have the right to request MAT revealing the resource of your Personal Data.

8.2 Right to data Rectification: You have the right to rectify your Personal Data which the Company collect, use, and disclose, to be corrected, updated, completed and not misleading.

8.3 Right to data Portability: You have the right to obtain your Personal Data, unless not technically feasible, (i) if MAT organizes such Personal Data in automatic machine-readable or usable format and can be processed or disclosed by automatic means, MAT will send or transfer such Personal Data directly to other data controllers, (ii) MAT will send or transfer such Personal Data directly to you.

8.4 Right to object: You have the right to object to the collection, use, and disclosure of your Personal Data, such as objections to direct marketing.

8.5 Right to restrict data processing: You have the right to restrict the use of your Personal Data in certain circumstances.

8.6 Right to withdraw consent: You have the right to withdraw your consent for the Company to collect, use, and disclose your personal data that has been given to you at any time.

8.7 Right to request deletion: You have the right to request that the Company delete Personal Data, or remove the identification of Personal Data collected by the Company, use, disclose and/or transfer (domestic or international) about you.

The exercise of rights above may be restricted under relevant laws and it may be necessary for MAT to deny or not be able to carry out your requests, if the Company is required to retain such information, in order to comply with its legal obligations, or to file a lawsuit, or exercise the right to sue, or fight a lawsuit, to comply with laws or court orders, public tasks, or your request is considered as a breach of rights or freedom of other persons. Although MAT denies the request, MAT will inform you of the reason. Either providing you pursuant to your request or deny your request, MAT will response to your request within 30 days from the day that you submit your request and MAT have already received all documents regarding MAT’s procedure and has completely verified your identity.

Moreover, you have the right to complain to Personal Data Protection Commission if you believe that the collection, use, disclosure, or denied response to your request, regarding your Personal Data is violating, or not in compliance with relevant law.
In this regard, you can proceed to apply for various rights in this regard through the channels outlined in Article 9.
